Lov3ly Terms of Service

Welcome to Lov3ly.
These Terms of Service ("Terms") govern your access to and use of the Lov3ly website, application, and related services (collectively, the "Service").
By creating an account, purchasing a Lov3ly plan, or using the Service, you agree to these Terms. If you do not agree, you should not use the Service.
1. About Lov3ly
Lov3ly is a digital wedding planning platform that provides couples and their wedding teams with a private workspace for organising wedding-related information, tasks, people, guests, vendors, budgets, documents, announcements, and other planning activities.
Lov3ly is a planning and organisation tool. It does not provide legal, financial, professional wedding, vendor, venue, or other professional advice.
2. Eligibility
You must be at least 18 years old and legally capable of entering into an agreement to use Lov3ly.
By using Lov3ly, you confirm that the information you provide is accurate and that you have the authority to create and manage the wedding workspace you create.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out through your account.
You must notify Lov3ly if you believe your account has been accessed without your permission.
You must not:
- share your password with another person;
- impersonate another person;
- create an account using false information;
- attempt to access another customer's wedding workspace;
- interfere with the operation or security of the Service; or
- use the Service for unlawful or abusive purposes.
4. Wedding Workspaces and Members
Lov3ly allows you to invite other people to participate in your wedding workspace.
You are responsible for deciding who receives access to your workspace and for the information and content that you and your invited members add to it.
You should only invite people who you intend to give access to your wedding information.
Workspace members may have different permissions depending on the features available to them.
You are responsible for ensuring that information shared with members is appropriate for those members to access.
5. Your Content
"You" or "Your Content" means information, text, images, documents, names, contact information, wedding details, budgets, vendor information, announcements, and other material that you or your authorised members submit to Lov3ly.
You retain ownership of Your Content.
You grant Lov3ly a limited, non-exclusive licence to host, store, process, reproduce, and display Your Content only as reasonably necessary to provide, maintain, secure, and improve the Service.
You are responsible for ensuring that you have the necessary rights and permissions to upload or share content through Lov3ly.
You must not upload content that:
- you do not have the right to use or share;
- is unlawful;
- infringes another person's intellectual property or privacy rights;
- contains malicious software; or
- is intended to harm, deceive, or abuse another person.
6. Personal Information
Lov3ly may process personal information contained in your account and wedding workspace, including information about wedding participants, guests, vendors, family members, and other individuals.
Our processing of personal information is described in our Privacy Policy, which forms part of these Terms.
You are responsible for ensuring that you have an appropriate basis and, where required, permission to provide personal information about other people to Lov3ly.
7. Subscription Plans
Lov3ly is offered through paid subscription plans.
The initial plans are:
- 6 months — US$59
- 12 months — US$89
The plans provide the same core features. The 12-month plan may be identified as the best-value option.
A subscription is associated with a wedding workspace rather than being charged separately for each member.
Unless otherwise stated at the time of purchase, the subscription period begins when the applicable payment is successfully completed and the workspace is activated.
Lov3ly may change its pricing for future purchases. Any price change will not alter a subscription period that you have already purchased.
8. Payments
Payments may be processed through a third-party payment provider.
Lov3ly does not normally receive or store your complete payment-card details.
The payment provider may have its own terms, privacy policy, and refund procedures.
A payment is considered completed when the payment provider confirms the transaction and Lov3ly is able to verify the applicable purchase.
9. Cancellation, Refunds and Expiry
Your subscription may be cancelled or expire according to the terms applicable to your purchase.
Refunds are governed by the Lov3ly Refund & Cancellation Policy, which forms part of these Terms.
When a subscription expires, access to paid features may be restricted.
Lov3ly may retain or delete workspace information after expiry in accordance with its retention practices and Privacy Policy.
You are responsible for exporting or otherwise retaining any information you wish to keep before your subscription expires.
10. Service Availability
We aim to keep Lov3ly available and reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, or available.
The Service may occasionally be unavailable because of:
- maintenance;
- upgrades;
- technical problems;
- third-party service interruptions;
- security incidents;
- circumstances beyond our reasonable control; or
- other operational reasons.
We will take reasonable steps to restore the Service when interruptions occur.
11. Third-Party Services
Lov3ly may rely on third-party services for functions such as hosting, authentication, email delivery, payment processing, storage, analytics, and other infrastructure.
Lov3ly is not responsible for interruptions or failures caused solely by third-party services, although we will take reasonable steps to address issues affecting the Service.
12. Intellectual Property
The Lov3ly name, branding, logo, website design, software, interface, features, documentation, and other original materials provided by Lov3ly are owned by or licensed to Lov3ly and are protected by applicable intellectual-property laws.
Your subscription gives you a limited right to use the Service during your active subscription period. It does not transfer ownership of Lov3ly or any part of its software to you.
You may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, or attempt to extract the source code of Lov3ly except where applicable law expressly permits it.
13. Feedback
If you provide suggestions, ideas, comments, or feedback about Lov3ly, you agree that we may use that feedback to improve the Service without owing you compensation.
14. Acceptable Use
You must use Lov3ly lawfully and responsibly.
You must not:
- attempt to gain unauthorised access to Lov3ly or another user's workspace;
- interfere with the security or operation of the Service;
- introduce malware or other harmful code;
- use automated systems to abuse or overload the Service;
- use Lov3ly to distribute unlawful or harmful material;
- use Lov3ly to harass, threaten, defraud, or harm another person; or
- attempt to use Lov3ly to circumvent access restrictions or subscription controls.
We may suspend or restrict access where reasonably necessary to protect Lov3ly, its users, or third parties.
15. Account Suspension or Termination
You may stop using Lov3ly at any time.
Lov3ly may suspend or terminate an account where we reasonably believe that:
- these Terms have been violated;
- the account is being used unlawfully;
- the account presents a security risk;
- the account is being used to abuse the Service or another user; or
- suspension is necessary to protect Lov3ly or its users.
Where reasonably practical, we will provide notice before termination unless immediate action is necessary for security, legal, or safety reasons.
16. Data and Security
We take reasonable measures to protect information stored through Lov3ly.
However, no internet service or electronic storage system can be guaranteed to be completely secure.
You are responsible for maintaining the security of your account credentials and for using appropriate security practices when accessing Lov3ly.
17. No Professional Advice
Lov3ly provides software and organisational tools.
Information, templates, reminders, calculations, suggestions, or other content provided through Lov3ly should not be treated as legal, financial, tax, medical, contractual, or other professional advice.
You are responsible for independently verifying information where professional advice is required.
18. Disclaimers
To the maximum extent permitted by applicable law, Lov3ly is provided on an "as available" basis.
We do not guarantee that:
- the Service will meet every individual requirement;
- the Service will always be available;
- information entered by users will be accurate;
- third-party services will always function; or
- the Service will be completely free from errors or interruptions.
Nothing in these Terms excludes or limits any consumer rights or other legal rights that cannot lawfully be excluded or limited.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Lov3ly will not be responsible for indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the Service.
Where liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
20. Changes to Lov3ly
We may add, modify, or remove features from Lov3ly as the Service develops.
We may also update these Terms from time to time.
When changes are material, we will take reasonable steps to notify users.
Your continued use of Lov3ly after updated Terms become effective means that you accept the updated Terms.
21. Governing Law
These Terms will be governed by the laws applicable to the entity operating Lov3ly and the jurisdiction specified at the time these Terms become legally binding.
The applicable jurisdiction will be identified and updated once the legal operating entity for Lov3ly has been established.
